Terms of Use

These terms are the agreement between you and AhaLearning, a Wisconsin business, for using Aha, an AI tutoring service for the ACT. By using Aha, you agree to these terms and to our Privacy Policy. If the student is under 18, a parent or guardian must agree to these terms on the student's behalf before the account is created, and is responsible for the student's use of Aha. In these terms, "you" means the student and, for students under 18, their parent or guardian.
1. What Aha is
Aha helps students prepare for the ACT with voice lessons from Sam, an AI tutor, plus practice sets and timed practice tests. All lessons, passages, and practice tests are written for Aha. They are not official ACT materials.
ACT is a registered trademark of ACT Education Corp. AhaLearning is not affiliated with or endorsed by ACT.
2. Who can use Aha
Aha is for students who are at least 13 years old. Students under 18 need a parent or guardian's permission, as described above.
3. Your account and access code
- Each student gets a private access code. It's for that student only. Don't share it.
- Tell us right away if a code is lost or someone else may know it, and we'll replace it.
- We may disable a code that's being shared or misused.
4. Fair use
Voice sessions with Sam include about 40 hours per student per calendar month, unless we've agreed on a different amount with you. Each session lasts up to about 60 minutes, and Sam wraps up when time is nearly up. Timed practice tests don't count toward the monthly time. We may adjust these limits to keep Aha working well for everyone, and we'll tell you before reducing them.
5. Using Aha responsibly
When using Aha, please don't:
- use it during a real ACT, or in any way that breaks ACT's rules or your school's academic honesty rules;
- let anyone else use your account, or record or share other people's sessions;
- say or type anything harassing, hateful, sexual, or otherwise inappropriate, or try to get Sam to;
- share private information about yourself or others beyond what's needed for studying;
- try to break, overload, copy, or reverse engineer Aha, get around its limits, or access anyone else's account or data;
- copy or republish Aha's lessons, passages, or practice tests.
6. About AI tutoring
- Sam is an AI, not a person. Sam is usually right but can make mistakes. If something seems off, ask Sam to explain again, or check with a teacher.
- Aha can help you prepare, but it can't promise any particular score or result.
- Sam is not a counselor, doctor, or emergency service. If you're in danger or need help right away, call 911. You can call or text 988 at any time to reach the Suicide and Crisis Lifeline.
7. Payment and refunds

8. Who owns what
AhaLearning owns Aha, including its software, lessons, passages, practice tests, and design. We give you a personal, non-transferable permission to use them for your own test preparation while your account is active. Your answers and work belong to you. You allow us to use them to provide Aha to you, as described in our Privacy Policy.
9. Changes, suspension, and ending your account
- We may update Aha, including adding, changing, or removing features or content.
- You can stop using Aha at any time and ask us to delete the account.
- We may suspend or close an account that breaks these terms. If we close an account for a reason other than a violation, we'll give notice [and a prorated refund, if you choose to offer one].
- If we change these terms, we'll post the new version here with a new date. If the change is significant, we'll also email the contact on file before it takes effect.
10. Disclaimers
Aha is provided "as is" and "as available." To the fullest extent the law allows, AhaLearning makes no warranties beyond those stated in these terms, including any implied warranties of merchantability or fitness for a particular purpose. We don't promise that Aha will be uninterrupted or error-free.
11. Limit of liability
To the fullest extent the law allows, AhaLearning is not liable for indirect, incidental, or consequential damages, such as a test score or an admissions decision, arising from your use of Aha. AhaLearning's total liability for any claim relating to Aha is limited to the amount you paid for Aha in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
12. Governing law
These terms are governed by the laws of the State of Wisconsin. Any dispute will be handled in the state or federal courts located in Wisconsin, unless the law where you live gives you the right to bring it elsewhere. Before starting any formal dispute, please contact us so we can try to resolve it informally.
